1. Introductory Provisions

1.1. This Complaints Policy governs the procedure and conditions for exercising rights arising from defective performance (complaints/claims) for goods purchased via the online store www.ami-exim.com

1.2. This Complaints Policy is issued in accordance with:

  • Act No. 89/2012 Coll., the Civil Code,

  • Act No. 634/1992 Coll., on Consumer Protection.

1.3. This Complaints Policy primarily applies to consumers (B2C).
For business customers (B2B) it applies only to an appropriate extent, unless otherwise agreed in writing.


2. Definitions

  • Seller: AMI exim s.r.o.

  • Buyer: a person who has concluded a purchase contract with the Seller.

  • Consumer (B2C): a natural person acting outside their business or professional activity.

  • Business Customer (B2B): a natural or legal person acting within their business activity (purchase under Company ID / VAT ID).


3. Liability for Defects – CONSUMERS (B2C)

3.1. The Seller is liable to the Consumer that the goods:

  • are free from defects upon receipt,

  • correspond to the description, type, quantity and quality,

  • are fit for their usual purpose.

3.2. The liability period for defects is 24 months from the date of receipt of the goods by the Consumer, unless the law provides otherwise.

3.3. If a defect becomes apparent within 12 months from receipt, it is presumed that the goods were defective upon receipt, unless proven otherwise.


4. Liability for Defects – BUSINESS CUSTOMERS (B2B)

4.1. Business customers are obliged to inspect the goods without undue delay after receipt.

4.2. Apparent defects must be reported immediately, no later than a few days after receipt.

4.3. Hidden defects must be reported without undue delay after discovery.

4.4. Business customers are not entitled to withdraw from the contract without stating a reason.


5. Exclusions from Liability (B2C and B2B)

The Seller shall not be liable for defects caused in particular by:

  • normal wear and tear,

  • improper or unprofessional use,

  • failure to follow the manufacturer’s instructions,

  • unauthorized repair or modification,

  • mechanical damage,

  • connection to an electrical network not complying with applicable standards,

  • force majeure or natural events.

⚠️ Consumable and wear parts (e.g. cables, hoses, motor carbon brushes) are covered only in the case of a proven manufacturing defect.


6. Rights Arising from Defective Performance – CONSUMERS (B2C)

Depending on the nature of the defect, the Consumer is entitled in particular to:

  • repair of the goods,

  • replacement of the goods,

  • a reasonable discount on the purchase price,

  • withdrawal from the contract,

in accordance with Sections 2169–2171 of the Civil Code.


7. Filing a Complaint

7.1. Complaints must be submitted by e-mail to info@ami-exim.com

.

7.2. The Buyer shall state:

  • order number,

  • description of the defect,

  • preferred method of resolution.

7.3. After confirmation by the Seller, the Buyer shall send the goods to the warehouse address:

Tesinky 23, 281 41 Ratboř, Czech Republic
(the goods must be properly packed and clearly marked with the order reference).


8. Complaint Handling

8.1. The Seller shall handle the complaint without undue delay, no later than 30 days from its submission, unless otherwise agreed with the Buyer.

8.2. In the case of a justified complaint, the Consumer is entitled to reimbursement of reasonably incurred costs (e.g. postage).

8.3. If the complaint is rejected, the Seller shall provide the Consumer with a written justification.


9. Final Provisions

9.1. This Complaints Policy forms an integral part of the Seller’s Terms and Conditions.

9.2. The Seller reserves the right to amend this Complaints Policy; the version effective on the date of purchase shall apply to a specific complaint.

9.3. This Complaints Policy is valid and effective as of 1 January 2026.
